The issue at hand with the Supreme Court was whether the four states remaining (Tennessee, Ohio, Michigan and Kentucky) same-sex marriage bans violated the 14th amendment of the U.S. Constitution. The 6th Circuit Court of Appeals found that those bans were constitutional. In 2003 the state of Massachusetts high court to find “to find a right to marriage equality in a state constitution” (Emily Bazelon, 2015). It is up to the higher courts of our United States to decide whether the federal Constitution will require all states to either license same-sex unions or to acknowledge those unions if they were performed somewhere else. There were thirty-seven states plus the District of Columbia that had marriage equality and the Obergefell v. Hodges case wanted the last four states to support the 14th amendment and legalize gay marriage. For many years people have been fighting with the courts to try to get gay marriage legalized as well as having the same benefits as regular marriages do. People just want the same respect and benefits as any other non- gay relationship has.
In a case a couple years ago (United States v. Windsor) “the question was whether Edith Windsor, whose same-sex marriage was recognized by the state of New York, could claim a federal tax exemption granted to spouses when her wife died and left Windsor her estate” (Emily Bazelon, 2015). These are the same rights that everyone wanted to make sure they were eligible for in case there was some type of issue to where one of their partners passed. For that case it was reached that federal marriage law had to track state marriage law. Even though many people still disagree with the court’s decision to pass this law and making gay marriage legal in all fifty states (5-4 ruling) it will be something that people either have to accept and adapt to or just look the other way if you do not agree with the courts decisions. People still have to live, people still have to work to support themselves and their families and people still have to have a place to live. There will always be that one ignorant individual to give a same sex couple grief because they disagree with how they choose to live their life. Whether I agree or disagree it is not my life and I let whoever lives however they want to live as long as they are not hurting me in the process.
